{"data":{"id":"us-ky/krs-367.932","jurisdiction":"us-ky","citation":"KRS 367.932","heading":"Definitions for KRS 367.934 to 367.974 and 367.991.","body":"As used in KRS 367.934 to 367.974 and 367.991:\n(1) \"Agent\" means the licensee who is the person, partnership, association or\ncorporation receiving any payments on a preneed funeral contract;\n(2) \"Attorney General\" means the Office of Consumer Protection in  the office of the\nAttorney General;\n(3) \"Bank of underground crypts\" means any construction unit of twenty (20) or more\nunderground crypts designed as a part of a below ground crypt program, whether\nphysically connected or not, having a common drainage system;\n(4) \"Cemetery\" means any one (1) or combination of more than one (1) of the\nfollowing in a place used or to be used and dedicated or designated for such\npurposes:\n(a) A burial park, for earth interment;\n(b) A mausoleum, for entombment;\n(c) A columbarium, for inurnment;\n(5) \"Cemetery company\" means any person who conducts the business of a cemetery.\nExcepted are small community cemeteries, their agents, lessees and otherwise that\noperate nonprofit; have no salaried employees, directors, officers or man agers other\nthan maintenance caretakers; are owned, controlled by lot owners; and do not sell\nany preneed merchandise or services;\n(6) \"Cemetery merchandise\" means urns, memorials, monuments, markers, vases,\nfoundations, memorial bases, and other similar personal property commonly sold by\nor used in cemeteries;\n(7) \"Columbarium\" means a structure or building substantially exposed above gr ound\nintended to be used for the inurnment of cremated remains and sold or offered for\nsale to the public;\n(8) \"Columbarium niche\" means an inurnment space in a columbarium as defined\nherein;\n(9) \"Financial institution\" means a bank, trust company, federal ly chartered credit\nunion, or savings and loan association authorized by law to do business in this state;\n(10) \"Grave space\" means a space of ground in a cemetery intended to be used for the\ninterment in the ground of the remains of one (1) human being;\n(11) \"Mausoleum\" means a building or structure substantially exposed above ground\nused or intended to be used for the entombment of human remains, which is sold or\noffered for sale to the public;\n(12) \"Mausoleum crypt\" means an entombment space in a mausoleum as defined herein;\n(13) \"Person\" means an individual, corporation, partnership, joint venture, association,\nbusiness trust, or any other form of business organization; provided, however, that\nan individual employee of an entity registered pursuant to KR S 367.934 to 367.974\nand 367.991 shall not be required to comply with the registration requirement\nherein;\n(14) \"Preneed burial contract\" means a contract, which has for a purpose the furnishing\nor performance of funeral services, or the furnishing or deli very of personal\nproperty, merchandise, or services of any nature in connection with the final\ndisposition of a dead human body, for future use at a time determinable by the death\nof the person whose body is to be disposed of; but does not mean the furnishing of a\ncemetery lot or mausoleum;\n(15) \"Preneed cemetery merchandise contract\" means any agreement or contract, or any\nseries or combination of agreements or contracts, which has for a purpose the\nfurnishing or delivery of cemetery merchandise, which wit hin six (6) months of the\ndate of the contract is not attached to the realty and permanently installed or which\nis not stored in a bonded warehouse with the receipt of ownership issued by the\nmanufacturer in the name of the purchaser and transmitted to the purchaser;\n(16) \"Remains\" means the bodies of deceased persons, in whatever stage of\ndecomposition, and cremated remains;\n(17) \"Trustee\" means the financial institution; and\n(18) \"Underground crypt\" means a single unit entombment space in preplaced chambe rs\nbelow ground and also known as lawn crypt, westminister turftop mausoleum, or\nbelow ground crypt.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54564","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"5e81fe1b16b69fa0efc5acd672bd289ade5fd233902a7b284c09522903a7d4f0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.93121","next":"us-ky/krs-367.934"},"notice":"GroundRules: Original legal text.
