{"data":{"id":"us-ky/krs-367.940","jurisdiction":"us-ky","citation":"KRS 367.940","heading":"License as agent required -- Fee -- Service charge -- Annual report to","body":"Attorney General -- Report not available to general public.\n(1) Every person, firm, partnership, association, or corporation shall obtain an agent\nlicense from the Attorney General  at least thirty (30) days prior to offering for sale\nany preneed burial contract or accepting any moneys on preneed burial contracts.\nAn application for license shall contain at least the following:\nThe full name and address (both residence and place of  business) of the\napplicant, and every member, officer, and director thereof if the applicant is a firm,\npartnership, association, or corporation. Any license issued pursuant to the\napplication shall be valid only at the address stated in the application f or the\napplicant or at a new address approved by the Attorney General.\n(2) Upon receipt of the application and payment of a license fee of fifty dollars ($50),\nthe Attorney General shall issue a license unless he determines that the applicant\nhas made fals e statements or representations in the application, or is insolvent, or\nhas conducted, or is about to conduct his business in a fraudulent manner, or is not\nduly authorized to transact business in this state.\n(3) Any person selling a preneed funeral servic e contract shall collect from each\npurchaser a service charge of five dollars ($5) made payable to the office of the\nAttorney General, and all of which fees so collected shall be remitted by the person\ncollecting same to the Attorney General at least once each month, and such funds\nshall be used by the Attorney General in administering KRS 367.932 to 367.974 and\n367.991.\n(4) Every licensee shall file an annual report on a form provided by the Attorney\nGeneral containing information as the Attorney General may require, but at least the\nfollowing: an itemized list of all preneed burial contracts sold within the last twelve\n(12) months, the moneys collected on said contracts, the total amount deposited in\nthe preneed funeral trust fund account, and the location and account numbers of said\ntrust funds. A ten dollar ($10) fee shall be paid to the office of the Attorney General\nby each licensee filing an annual report.\n(5) Every such report shall be verified by the agent and shall be attested to by the\naccountant, auditor, or other person preparing the same.\n(6) Such reports shall not be available to the general public and shall be used only for\nthe lawful purpose of the Attorney General's office.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35117","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"50a92ffd520e2928bdd23cdb9d3e940738f89dbb8621a9af3e7c95e5aa75068d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.938","next":"us-ky/krs-367.942"},"notice":"GroundRules: Original legal text.
