{"data":{"id":"us-ky/krs-367.946","jurisdiction":"us-ky","citation":"KRS 367.946","heading":"Registration of person selling cemetery merchandise and every cemetery","body":"company -- Fee -- Annual report.\n(1) Every person engaged in the sale of any preneed cemetery merchandise contract and\ncemetery company, hereinafter referred to as registrants, sha ll register with the\nAttorney General at least thirty (30) days prior to commencing to do business. Such\nregistration shall be on forms provided by the Attorney General and shall contain at\nleast the following information.\n(a) The name and location of the cemetery;\n(b) The size and type;\n(c) The names, addresses, and other relative information concerning the owners,\nofficers, and directors;\n(d) Identification, location, and total amounts deposited in the perpetual care and\nmerchandise trust funds;\n(e) Types of services and merchandise sold and whether at need or preneed.\n(2) Every registrant shall, within sixty (60) days of any material change of any item\nrequired to be reported hereunder, notify the department of such change.\n(3) Every registrant shall pay a filing fee of fifty dollars ($50) with its application.\n(4) Every registrant shall file an annual report on a form provided by the Attorney\nGeneral containing information as the Attorney General may reasonably require, but\nat least the following:\n(a) The total amount deposited in the perpetual care and maintenance trust fund,\nand a listing of the total number of grave spaces, underground crypts,\nmausoleums, and niches sold within the last twelve (12) months and the gross\nselling price of each;\n(b) The total amount deposited in the cemetery merchandise trust fund account,\nand a listing of the total number of the different cemetery merchandise sold\nwithin the last twelve (12) months and the retail selling price of each; and\n(c) The total amount deposited in the preconstruction trust fund accounts, and a\nlisting of the total number of mausoleum crypts, niches, and underground\ncrypts sold within the last twelve (12) months and the retail selling price of\neach and current balance.\n(5) Every such report shall be verified by the registrant and shall be attested to by any\nother person preparing the same.\n(6) Such reports shall not be available to the general public and shall be used only for\nthe lawful purpose of the Attorney General's office.\n(7) A ten dollar ($10) fee shall be paid to the office of the Attorney General by each\nregistrant filing an annual report.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35120","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"196fff12d3ea1f105069bc04184da1b245ca4c8589469a45dd25f41af8e4430b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.944","next":"us-ky/krs-367.948"},"notice":"GroundRules: Original legal text.
