{"data":{"id":"us-ky/krs-367.962","jurisdiction":"us-ky","citation":"KRS 367.962","heading":"Allocation of payments -- Increase of gross sale price prohibited.","body":"(1) Whenever any contract for sale shall be entered into in which items of cemetery\nmerchandise and rights to interment, inurnment or entombment are included,\nwithout allocation of the gross sale price among the items sold, the application of\npayments received  under the contract shall be allocated, first to the right to\ninterment, inurnment or entombment, second to items of cemetery merchandise\nrelating to memorialization and third, to items relating to the disposition of the\nremains of a dead human being, incl uding preneed funeral merchandise and\nservices, unless some other allocation is clearly provided in the contract.\n(2) Any person engaging in a combination sale which involves the sale of any item in\naddition to the sale of cemetery merchandise or a combina tion sale which involves\nthe sale of any item in addition to the sale of rights to interment, inurnment or\nentombment shall be prohibited from increasing the gross sales price of those items\nwhich require the lesser trust fund deposit with the purpose of a llocating a lesser\ngross sales price to items which require a higher trust fund requirement.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35128","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"c76352ae53c0edebe2f2f1f71783e63592c29bf9cdbb177afebe50ef69581b85","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.960","next":"us-ky/krs-367.964"},"notice":"GroundRules: Original legal text.
