{"data":{"id":"us-ky/krs-367.964","jurisdiction":"us-ky","citation":"KRS 367.964","heading":"Consumer security account.","body":"(1) Any person selling preneed cemetery merchandise contracts or preconstruction\nmausoleums, columbarium or underground crypt contracts shall pay to the Attorney\nGeneral five dollars ($5) for each said contract entered into of which the gross sales\nprice as de fined in KRS 367.932 to 367.974 and 367.991 is five hundred dollars\n($500) or less and ten dollars ($10) for each said contract entered into of which the\ngross sales price is over five hundred dollars ($500), to be paid into a special\nincome earning accoun t known as \"Consumer security account.\" The above said\nfees shall be remitted to the Attorney General at least once each month.\n(2) The funds in said account shall be used solely for the purpose of providing\nrestitution to consumers who have suffered pecun iary loss in the purchase of a\npreneed cemetery merchandise contract or a preconstruction mausoleum,\ncolumbarium or underground crypt contract. The fund shall be applied only to\nrestitution that is ordered by Circuit Court in a lawsuit brought under KRS 36 7.932\nto 367.974 and 367.991 by the Attorney General and which is determined by the\nAttorney General to be noncollectible from the judgment debtor.\n(3) Whenever restitution is paid by the fund, the fund shall be subrogated to the amount\nof such restitution , and the Attorney General shall engage in all reasonable post\njudgment collection steps to collect said restitution from the judgment debtor and\nreimburse the fund.\n(4) The fund shall not be applied toward any restitution for losses in any lawsuit\ninitiated by the Attorney General prior to July 13, 1984.\n(5) Notwithstanding any other provision of this section, the payment of restitution from\nthe fund shall be a matter of grace and not of right and no person shall have any\nvested rights in the fund as a beneficiary or otherwise.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35129","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"3a24c1a44c96618092a195e57b0a24e6b82b3de85d147fd7bb4c7bbe17bf8e8e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.962","next":"us-ky/krs-367.966"},"notice":"GroundRules: Original legal text.
