{"data":{"id":"us-ky/krs-367.973","jurisdiction":"us-ky","citation":"KRS 367.973","heading":"Disciplinary powers of Attorney General -- Hearing -- Appeal.","body":"(1) The Attorney General may deny, suspend, or revoke any license granted under KRS\n367.940 or levy civil penalties not to exceed five hundred dollars ($500) or both or\nplace the licensee on probation for up to twelve (12) months for any of the\nfollowing causes:\n(a) Obtaining a license through false statement or misrepresentation;\n(b) Conducting, or undertaking a substantial step toward conducting his business\nin an unfair, false, misleading, or deceptive manner;\n(c) Entry of a final civil judgment against the licensee for a violation of KRS\n367.934 to 367.974, or for entry of a final judgment of conviction for a\nviolation of KRS 367.991;\n(d) Entry of a final judgment of conviction against the licensee for any crime\ninvolving moral turpitude; or\n(e) Violating an y of the provisions of KRS 367.932 to 367.974 or any lawful\norder or administrative regulation made or promulgated under KRS 367.932\nto 367.974.\n(2) The Attorney General shall, before denying, suspending, or revoking a license or\nimposing fines, file a com plaint alleging the grounds upon which the licensee may\nhave his license denied, revoked, or suspended or have fines imposed. A copy of the\ncomplaint, together with any exhibits, shall be served upon the defendant licensee at\nthe licensee's last known addr ess. The complainant shall show certification that\nthere has been service by writing to the last known address. The answer shall be\nreturned to the Attorney General's office within twenty (20) days of receipt of the\ncomplaint by the defendant licensee. Upo n receipt of an answer to a complaint, an\nadministrative hearing shall be conducted in accordance with KRS Chapter 13B.\n(3) Any person aggrieved by a final order issued under authority of this section shall\nhave the right of an appeal by filing a petition with the Franklin Circuit Court in\naccordance with KRS Chapter 13B.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35134","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"2ac7d74b0c3766e6932306b49e0df5b1604a5ab1465321d6372a5b854b7c51e2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.972","next":"us-ky/krs-367.974"},"notice":"GroundRules: Original legal text.
