{"data":{"id":"us-ky/krs-367.97514","jurisdiction":"us-ky","citation":"KRS 367.97514","heading":"Processing procedures and restrictions.","body":"(1) The simultaneous cremation of the remains of more than one (1) individual within\nthe same cremation chamber is specifically declared unlawful. The fact that\nincidental and unavoidable residue remains in the cremation chamber or other\nequipment or any conta iner used in a prior cremation is not a violation of this\nsection.\n(2) No human remains delivered to a crematory shall be removed from the cremation\ncontainer, and the cremation container shall be cremated with the human remains.\nThe identification from the outside of the cremation container shall be removed and\nplaced near the cremation chamber control panel where it shall remain in place until\nthe cremation process is complete.\n(3) A body shall not be cremated with a pacemaker or other potentially hazardo us\nimplant, including any toxic or explosive -type sealed implants, in place. If the\nauthorizing agent is the decedent, the declarant shall disclose the existence of any\npacemaker or other hazardous implants to the crematory authority, or in the event\nthere is no declaration, then the next class of authorizing agent in the order set forth\nin KRS 367.97501(1) shall be responsible for disclosing the existence of any\npacemaker or other hazardous implants to the crematory authority.\n(4) No crematory authority or  any person employed by or acting on behalf of a\ncrematory authority shall remove or possess dental gold or dental silver from any\nhuman remains. The fact that there is incidental and unavoidable dental gold or\ndental silver remains in the cremation chambe r, in other equipment, or in any\ncontainer used in a prior cremation is not a violation of this section.\n(5) The crematory or crematorium shall be secure from access by unauthorized persons.\n(6) The crematory retort operator shall have at least forty eight  (48) hours of on the job\ntraining supervised by the crematory operator, with verification of this training\nhaving been filed with the Attorney General.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45053","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"609421f84a412a0793f4f548b8cfc7b2096856731100cb69afc30ccff6afbeaf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.97511","next":"us-ky/krs-367.97517"},"notice":"GroundRules: Original legal text.
