{"data":{"id":"us-ky/krs-367.97524","jurisdiction":"us-ky","citation":"KRS 367.97524","heading":"Cremation authorization form required -- Disposal or delivery of","body":"cremated remains -- Unclaimed cremated remains -- Limitation of liability.\n(1) A crematory authority shall not conduct any cremations, nor accept a body for\ncremation, unless it  has a cremation authorization form signed by the authorizing\nagent clearly stating the disposition to be made of the cremated remains.\n(2) Cremated remains shall be disposed of by placing them in a grave, crypt, or niche;\nby scattering them in a scattering area; or in any manner on the private property of a\nconsenting owner. The crematory authority or funeral director as defined in KRS\n316.010 may deliver, either in person or by a method that has an internal tracking\nsystem that provides a receipt signed by the person accepting delivery, the cremated\nremains to the designated individual specified on the cremation authorization form.\nUpon receipt of the cremated remains, the individual receiving them may keep or\ntransport them in any manner in this Commonwea lth without a permit. After\ndelivery, the crematory authority or funeral home shall be discharged from any legal\nobligation or liability concerning the cremated remains relative to disposition.\n(3) If the cremated remains have remained unclaimed for a peri od of at least two (2)\nyears, a funeral director may inter, bury, entomb, or place the cremated remains in a\ncolumbarium or may deliver the cremated remains to a bona fide religious society,\nveterans organization, or civic group in person or by a delivery method that utilizes\nan internal tracking system that provides a receipt signed by the individual\naccepting delivery, for the sole purpose of interment, burial, entombment, or\nplacement in a columbarium. If such a delivery is made, the funeral director or\ncrematory authority shall maintain records of the delivery for at least ten (10) years\nfrom the date of delivery.\n(4) A crematory authority or a licensed funeral director arranging a cremation shall not\nbe held liable for good faith reliance on representat ions made by the authorizing\nagent regarding the authority to cremate.\n(5) A crematory authority or licensed funeral director shall not be held liable for\ndelivering cremated remains that have been in their possession for two (2) years or\nmore to a bona fi de religious society, veterans group, or civic organization for the\nsole purpose of interment, burial, entombment, or placement in a columbarium.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48847","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"7e25fc49f89800cf7f9b64ae7f551379d09c7bc773ae3e2445e5b3705f2837ce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.97521","next":"us-ky/krs-367.97527"},"notice":"GroundRules: Original legal text.
