{"data":{"id":"us-ky/krs-367.97527","jurisdiction":"us-ky","citation":"KRS 367.97527","heading":"Funeral planning declaration directing cremation.","body":"(1) A person may authorize his or her own cremation and the final disposition of his or\nher cremated remains, by executing a declaration. The original declaration directing\ncremation shall be retained by the entity with which the arrangements are made. A\ncopy of the declaration shall be provided to the person signing the preneed\narrangements. The person prearranging his own cremation shall have the right to\ntransfer or cancel the declaration at any time prior to death, by notifying the entity\nwith which the declaration is filed by certified mail.\n(2) In the event that no different or inconsistent instructions are provided to the\ncrematory authority at the time of death, the crematory authority shall release or\ndispose of the cremated remains as indicated in the cremation authorization or\ndeclaration.\n(3) Neither the crematory authority nor a licensed funeral director arranging a\ncremation shall be held liable for the crematory authority's or the funeral director's\ngood faith reliance on representations made by th e declaration or authorizing agent\nregarding the authority or decision to cremate.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45055","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"4be96d713f1274fcfde1d17f23e59a5b620126f7e5dc80e7449c13982cd6fddf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.97524","next":"us-ky/krs-367.97531"},"notice":"GroundRules: Original legal text.
