{"data":{"id":"us-ky/krs-367.985","jurisdiction":"us-ky","citation":"KRS 367.985","heading":"Effect of unintentional violation and timely adjustment of error.","body":"(1) A lessor shall not be liable under KRS 367.983 for a violation of KRS 367.976 to\n367.985 if the lessor shows by a preponderance of the evidence that the violation\nwas not inten tional and resulted from a bona fide error, such as a clerical\nmiscalculation, computer malfunctions, programming error, or printing error, even\nthough the lessor maintained procedures reasonably adapted to avoid such an error.\nAn error of legal judgment w ith respect to requirements of this title shall not be\nconsidered a bona fide error.\n(2) A lessor shall not be liable under KRS 367.983 for any act done or omitted in good\nfaith in conformity with any administrative regulation or interpretation promulgated\nby the Attorney General or by the office or by an official duly authorized by the\nAttorney General or by the office. This rule shall apply even if, after the act or\nomission has occurred, the regulation or interpretation is amended, rescinded, or\ndetermined by judicial or other authority to be invalid for any reason.\n(3) A lessor shall not be liable under KRS 367.983 for any error if, before the thirty -\nfirst day after the date the merchant discovers the error and before an action against\nthe lessor has bee n filed or written notice of the error received by the lessor, the\nlessor gives the consumer written notice of the error and makes adjustments in the\nconsumer's account as necessary to assure that the consumer will not be required to\npay an amount in exces s of the amount disclosed and that the agreement otherwise\ncomplies with KRS 367.976 to 367.985.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54569","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"de13ae9fbc5fe792da324dd78a6abfb205c6a8ec82d54bc691a3af2fccddae78","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.984","next":"us-ky/krs-367.990"},"notice":"GroundRules: Original legal text.
