Whether the parties agree to\nconduct a transaction by electronic means is determin ed from the context and\nsurrounding circumstances, including the parties' conduct.\n(3) A party that agrees to conduct a transaction by electronic means may refuse to\nconduct other transactions by electronic means. The right granted by this subsection\nmay not be waived by agreement.\n(4) Except as otherwise provided in KRS 369.101 to 369.120, the effect of any of its\nprovisions may be varied by agreement.
