{"data":{"id":"us-ky/krs-369.108","jurisdiction":"us-ky","citation":"KRS 369.108","heading":"Provision of information in writing -- Presentation of records.","body":"(1) If parties have agreed to conduct a transaction by electronic means and a law\nrequires a person to provide, send, or deliver information in writing to another\nperson, the requirement is satisfied if the information is provided, sent, or delivered,\nas the c ase may be, in an electronic record capable of retention by the recipient at\nthe time of receipt. An electronic record is not capable of retention by the recipient\nif the sender or its information processing system inhibits the ability of the recipient\nto print or store the electronic record.\n(2) If a law other than KRS 369.101 to 369.120 requires a record to be posted or\ndisplayed in a certain manner, to be sent, communicated, or transmitted by a\nspecified method, or to contain information that is formatte d in a certain manner,\nthe following rules apply:\n(a) The record must be posted or displayed in the manner specified in the other\nlaw.\n(b) Except as otherwise provided in subsection (4)(b) of this section, the record\nmust be sent, communicated, or transmit ted by the method specified in the\nother law.\n(c) The record must contain the information formatted in the manner specified in\nthe other law.\n(3) If a sender inhibits the ability of a recipient to store or print an electronic record, the\nelectronic record is not enforceable against the recipient.\n(4) The requirements of this section may not be varied by agreement, but:\n(a) To the extent a law other than KRS 369.101 to 369.120 requires information\nto be provided, sent, or delivered in writing but permits tha t requirement to be\nvaried by agreement, the requirement under subsection (1) of this section that\nthe information be in the form of an electronic record capable of retention may\nalso be varied by agreement; and\n(b) A requirement under a law other than KRS  369.101 to 369.120 to send,\ncommunicate, or transmit a record by United States mail may be varied by\nagreement to the extent permitted by the other law.","path":["KRS Chapter 369"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35207","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:07Z","sha256":"a5da6e516ec436a2bcade9669083febe4624b0fcad1bdc7fb18dbfbe2d319bae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-369.107","next":"us-ky/krs-369.109"},"notice":"GroundRules: Original legal text.
