{"data":{"id":"us-ky/krs-369.118","jurisdiction":"us-ky","citation":"KRS 369.118","heading":"Acceptance and distribution of electronic records by governmental","body":"agencies.\n(1) Except as otherwise provided in KRS 369.112(6), each governmental agency of this\nstate, in compliance with standards established by the Commonwealth Office of\nTechnology, shall determine whether, and the extent to which, it will send and\naccept electronic records and electronic signatures to and from other persons and\notherwise create, generate, communicate, store, process, use, and rely upon\nelectronic records and electronic signatures.\n(2) To the extent that a governmental agency uses electronic reco rds and electronic\nsignatures under subsection (1) of this section:\n(a) The Commonwealth Office of Technology, giving due consideration to\nsecurity, may specify the manner and format in which the electronic records\nmust be created, generated, sent, communi cated, received, and stored and the\nsystems established for those purposes;\n(b) If electronic records must be signed by electronic means, each governmental\nagency, giving due consideration to security, may specify the type of\nelectronic signature required,  the manner and format in which the electronic\nsignature must be affixed to the electronic record, and the identity of, or\ncriteria that must be met by, any third party used by a person filing a document\nto facilitate the process;\n(c) The Commonwealth Offi ce of Technology and the Department for Libraries\nand Archives, giving due consideration to security, may specify control\nprocesses and procedures as appropriate to ensure adequate preservation,\ndisposition, integrity, security, confidentiality, and audita bility of electronic\nrecords; and\n(d) Each governmental agency, giving due consideration to security, may specify\nany other required attributes for electronic records which are specified for\ncorresponding nonelectronic records or reasonably necessary under  the\ncircumstances.\n(3) Except as otherwise provided in KRS 369.112(6), KRS 369.101 to 369.120 does\nnot require a governmental agency of this state to use or permit the use of electronic\nrecords or electronic signatures.","path":["KRS Chapter 369"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35217","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:07Z","sha256":"6eb50b170f952229f40cf85ad7ecc9e7b5a67883258b754ef53129f5bf5f2dce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-369.117","next":"us-ky/krs-369.119"},"notice":"GroundRules: Original legal text.
