{"data":{"id":"us-ky/krs-371.370","jurisdiction":"us-ky","citation":"KRS 371.370","heading":"Definitions for KRS 371.375 to 371.385.","body":"As used in KRS 371.375 to 371.385, unless the context otherwise requires:\n(1) \"Commissions\" means compensation accruing to a sales representative for payment\nby a principal, the rate of which is expressed as a percentage of the amount of\norders or sales or as a specified amount per order or per sale.\n(2) \"Person\" means an individual, corporation, partnership, association, estate, or trust.\n(3) \"Principal\" means a person who does not have a permanent or fixed place of\nbusiness in this state and who:\n(a) Manufactures, produces, imports, or distributes a tangible product for\nwholesale;\n(b) Contracts with a sales representative to solicit orders for the product; and\n(c) Compensates the sales representative, in whole or in part, by commission.\n(4) \"Sales representative\" means a person who:\n(a) Contracts with a principal to solicit wholesale orders;\n(b) Is compensated, in whole or in part, by commission;\n(c) Does not place orders or purchase for his own account or for resale; and\n(d) Does not sell or take orders for the sale of products to the ultimate consumer.","path":["KRS Chapter 371"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35253","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:08Z","sha256":"75b55da13ce0bed197a5b56eb03ecd66af5ec11370facb9f25bb63bc55db0bf0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-371.330","next":"us-ky/krs-371.375"},"notice":"GroundRules: Original legal text.
