{"data":{"id":"us-ky/krs-371.375","jurisdiction":"us-ky","citation":"KRS 371.375","heading":"Termination of contract -- Civil action -- Liability of principal or sales","body":"representative.\n(1) When a contract between a sales representative and a principal is terminated for any\nreason, the principal shall pay the sales representative all commission s accrued\nunder the contract to the sales representative within thirty (30) days after the\neffective date of such termination.\n(2) A principal who fails to comply with the provisions of subsection (1) of this section\nshall be liable to the sales representative in a civil action for:\n(a) All amounts due the sales representative, plus exemplary damages in an\namount not to exceed two (2) times the amount of commissions due the sales\nrepresentative; and\n(b) Attorney's fees actually and reasonably incurred by th e sales representative in\nthe action and court costs.\n(3) Where the court determines that an action brought by a sales representative against\na principal under KRS 371.370 to 371.385 is frivolous, the sales representative shall\nbe liable to the principal f or attorney's fees actually and reasonably incurred by the\nprincipal in defending the action and court costs.\n(4) Nothing in KRS 371.370 to 371.385 shall invalidate or restrict any additional right\nor remedy available to a sales representative or preclude a sales representative from\nseeking to recover in an action on any other claim against a principal.","path":["KRS Chapter 371"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35254","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:08Z","sha256":"3a6b95f711bb5c85b05ec061b8cadf10b811e438122b4ccea9fba6bd647cb0ad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-371.370","next":"us-ky/krs-371.380"},"notice":"GroundRules: Original legal text.
