{"data":{"id":"us-ky/krs-371.400","jurisdiction":"us-ky","citation":"KRS 371.400","heading":"Definitions for KRS 371.400 to 371.425.","body":"As used in KRS 371.400 to 371.425:\n(1) \"Construction\" means the process of building, altering, repairing, improving, or\ndemolishing any structures or buildings, or other improvements of any kind to any\nreal property, but does not include processing equipment used for the process of\nmanufacturing or the routine maintenance of existing structures, buildings, or real\nproperty;\n(2) \"Contract\" means a contract or agreement concerning construction made and\nentered into by and between a contracting entity and a contractor, a contractor and a\nsubcontractor, or a subcontractor and another subcontractor;\n(3) \"Contracting entity\" means an owner of real property; a trustee or agent of an owner\nof real property; or a public official, public authority, or other public entity\nauthorized to contract under the Kentucky Revised Statutes;\n(4) \"Contractor\" means a person performing construction and having a contract with a\ncontracting entity;\n(5) \"Disputed amount\" means to question in good faith the validity, either in whole or\npart, of a request for payment asserted by any party;\n(6) \"Owner\" means a person who holds an ownership interest in real property;\n(7) \"Person\" means an individual, corporation, estate, trust, partnership, limited liability\ncompany, association, joint venture, or any other legal entity;\n(8) \"Processing equipment\" means equipment which uses physical or chemical methods\nto increase the value of a raw material or product and is installed by the person\ncontractually responsible to the contracting entity for the design, purchase,\ninstallation, and performance of that equipment;\n(9) \"Retainage\" means money earned by a contractor or subcontractor but withheld to\nensure proper performance by the contractor or subcontractor and that shall be paid\nupon completion of contractual obligations;\n(10) \"Subcontractor\" means any person performing construction covered by a contract\nbetween a contracting entity and a contractor who does not have a contract with the\ncontracting entity; and\n(11) \"Undisputed amount\" means a good faith, valid, accurate, timely reques t for\npayment which has been submitted to any entity owing money, that the recipient of\nthe request for payment has reviewed and agrees that the money is due and owing.","path":["KRS Chapter 371"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35257","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:08Z","sha256":"cdf562be6062ed72f5ac6f5f20417a54e7d33a1edc20b57d3e0745e1dca9b1bb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-371.385","next":"us-ky/krs-371.405"},"notice":"GroundRules: Original legal text.
