{"data":{"id":"us-ky/krs-371.990","jurisdiction":"us-ky","citation":"KRS 371.990","heading":"Penalties.","body":"(1) Any person who violates any of the provisions of KRS 371.130, or assents to any\nsuch violation shall be fined not less than fifty (50) nor more than two hundred\ndollars ($200) for each offense.\n(2) Any person who shall willfully and intentionally violate a ny provision of KRS\n371.210 to 371.330 shall be guilty of a misdemeanor and upon conviction shall be\npunished by a fine not exceeding five hundred dollars ($500) or by imprisonment\nfor not more than six (6) months, or both.\n(3) Any person who violates any provision of KRS 371.210 to 371.330 except as a\nresult of an accidental or bona fide error shall be barred from the recovery of any\ntime price differential, or any delinquency or collection charge under or in\nconnection with the related installment contrac t or retail charge agreement; but the\nholder may nevertheless recover from the buyer an amount equal to the cash price\nof the goods or services and the cost to the seller or holder of any insurance\nincluded in the transaction.\n(4) Notwithstanding the provi sions of subsections (2), (3) and (4) of this section, any\nfailure, other than a willful and intentional failure, to comply with any provision of\nKRS 371.210 to 371.330 may be corrected within ten (10) days after the holder is\nnotified thereof in writing by the buyer and, if so corrected, neither the seller nor the\nholder is subject to any penalty under subsections (2), (3) and (4) of this section.","path":["KRS Chapter 371"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35263","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:08Z","sha256":"1dac108da24171d80e14a72569f81c4410ecf4e4c21f9ee8381a6cd769e2f2b2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-371.425","next":"us-ky/krs-372.005"},"notice":"GroundRules: Original legal text.
