{"data":{"id":"us-ky/krs-376.475","jurisdiction":"us-ky","citation":"KRS 376.475","heading":"Filing requirement -- Indexing -- Dissolution for nonenforcement.","body":"(1) Any lien provided for in KRS 376.470 shall be dissolved unless the claimant, within\nsix (6) months after he ceases to provide services for the animal, files in the office\nof the county clerk of the county in which the animal is located, a statement of the\namount due him, together with a description of the animal intended to be covered by\nthe lien sufficiently accurate to identify it, the name of the owner, and whether the\nservices were furnished by contract or written consent of the owner or agent. This\nstatement shall be subscribed and sworn to by the person claiming the lien or by\nsomeone in his behalf. The claimant shall send by regular mail a copy of the\nstatement to the owner at his last known address within seven (7) days of filing the\nstatement with t he county clerk. Any lien provided for in KRS 376.470 shall be\ndissolved if a copy of the statement is not sent to the property owner as provided in\nthis subsection.\n(2) The county clerk shall endorse upon each statement the date of its filing, and shall\nmake an abstract of the statement in a book to be kept by him for that purpose,\nproperly endorsed and indexed, containing the date of filing, the name of the person\nseeking to enforce the lien, the amount claimed, the name of the person against\nwhose animal the lien is filed, and a description of the animal charged with the lien.\nThe clerk shall receive a fee pursuant to KRS 64.012 from the person filing the\nstatement as full compensation, which shall be taxed and collected as other costs.\n(3) Any lien created under this section shall be dissolved unless an action is brought to\nenforce the lien within twelve (12) months from the day of filing the statement in\nthe clerk's office as required by subsection (1) of this section. If the lienholder\ncomplies with all filing requirements under this section, and does so within the time\nherein fixed, his lien shall be valid and effective against any creditor of, or bona fide\nor other purchaser from, the owner of the animal, except as provided in KRS\n257.105(2).\n(4) The procedure to enforce a lien under KRS 376.470 shall be as provided in KRS\n376.110, 376.120, and 376.130.","path":["KRS Chapter 376"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35340","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"530deeab328c762f45b2ccfe00b5ce1d74368ef960f04c6d7edcbc3d2427d9d9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-376.470","next":"us-ky/krs-376.480"},"notice":"GroundRules: Original legal text.
