{"data":{"id":"us-ky/krs-376.480","jurisdiction":"us-ky","citation":"KRS 376.480","heading":"Lien for rent due on space for parking abandoned house trailer or mobile","body":"home -- Sale of abandoned property.\n(1) Any owner of real property who rents space on which a house trailer or mobile\nhome is parked shall have a lien for rent due on any house t railer or mobile home,\nits contents, and other personalty abandoned by the occupant on the landowner's\nproperty for rent due, reasonable storage, cleanup costs, and utilities furnished to the\nunit and paid for by the landowner.\n(2) If, after a period of si xty (60) days, the rent, reasonable storage, cleanup costs, and\nutilities have not been paid, the house trailer or mobile home, its contents, and other\npersonalty abandoned by the occupant may be sold to pay the rent, reasonable\nstorage, cleanup costs, and utilities after the unit owner has been notified of the time\nand place of the sale, at the unit owner's last known address. Notice shall be made\nby registered mail at least ten (10) days prior to the time of the sale. If there is a\nvalid recorded lien aga inst the property to be sold, the landowner shall notify the\nlienholder of the time and place of sale by registered mail at least ten (10) days prior\nto the time of the sale. If the proceeds of the sale are insufficient to pay the debt and\ncosts of sale, t he sale and collection of proceeds shall not constitute a waiver or\nrelease of responsibility for payment of the debt owed by the unit owner. This lien\nshall be subject to prior recorded liens and property taxes.\n(3) Any money obtained in excess of the sale costs, taxes, and liens shall be paid by the\nseller to the unit owner; and if the unit owner cannot be located, the excess money\nshall escheat to the state pursuant to the provisions of KRS Chapter 393.\n(4) Before the sale, the landowner shall advertise a description of the property to be\nsold and the time and place of sale for three (3) consecutive publishing periods in a\nlocal newspaper distributed in the county where the property is located.\n(5) The sale may be by written bids or by auction, or both, and the seller may bid on the\nproperty. The sale shall be to the highest bidder.\n(6) The house trailer or mobile home shall be transferred to the purchaser in the county\nwhere the sale is conducted upon an affidavit being filed by the seller stating that\nthe provisions of this section have been met, listing the sale price, and containing\nany other information that may be required by the state or county.","path":["KRS Chapter 376"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35341","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"e72fc111526553fc8f1f214e891e4e91391c79f06aaadd5d44911f2d8f92be23","source_id":"us-ky","stale":false,"prev":"us-ky/krs-376.475","next":"us-ky/krs-376.990"},"notice":"GroundRules: Original legal text.
