{"data":{"id":"us-ky/krs-378a.030","jurisdiction":"us-ky","citation":"KRS 378A.030","heading":"Value.","body":"(1) Value is given for a transfer or an obligation if, in exchange for the transfer or\nobligation, property is transferred or an antecedent debt is secured or satisfied, but\nvalue does not include an unperformed promise made otherwise than in the ordinary\ncourse of the promisor's business to furnish support to the debtor or another person.\n(2) For the purposes of KRS 378A.040(1)(b) and 378A.050, a person gives a\nreasonably equivalent value if the person acquires an interest of the debtor in an\nasset pursuant to  a regularly conducted, noncollusive foreclosure sale or execution\nof a power of sale for the acquisition or disposition of the interest of the debtor\nupon default under a mortgage, deed of trust, or security agreement.\n(3) A transfer is made for present v alue if the exchange between the debtor and the\ntransferee is intended by them to be contemporaneous and is in fact substantially\ncontemporaneous.","path":["KRS Chapter 378A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44723","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"04d1bfbe86714a09578fb0894e6fb9b1548b98be2f0487519a029f172cc0f660","source_id":"us-ky","stale":false,"prev":"us-ky/krs-378a.020","next":"us-ky/krs-378a.040"},"notice":"GroundRules: Original legal text.
