{"data":{"id":"us-ky/krs-378a.050","jurisdiction":"us-ky","citation":"KRS 378A.050","heading":"Transfer or obligation voidable as to present creditor.","body":"(1) A transfer made or obligation incurred by a debtor is voidable as to a creditor whose\nclaim arose before the transfer was made or the obligation was incurred if the debtor\nmade the transfer or incurred the obligation without receiving a reasonably\nequivalent value in exchange for the transfer or obligation and the debtor was\ninsolvent at the time or the debtor became insolvent as a result of the transfer or\nobligation.\n(2) A transfer made by a debtor is voidable as to a creditor whose claim arose before\nthe transfer was made, if the transfer was made to an insider for an antecedent debt,\nthe debtor was insolvent at that time, and the insider had reasonable cause to believe\nthat the debtor was insolvent.\n(3) Subject to KRS 378A.020(2), a creditor making a cla im for relief under subsection\n(1) or (2) of this section has the burden of proving the elements of the claim for\nrelief by a preponderance of the evidence.","path":["KRS Chapter 378A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44725","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"6a7e3b499eca87a30d34fe9e7dd351ddc20bc4ea95ef77c0738fb42245f358ee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-378a.040","next":"us-ky/krs-378a.060"},"notice":"GroundRules: Original legal text.
