{"data":{"id":"us-ky/krs-378a.110","jurisdiction":"us-ky","citation":"KRS 378A.110","heading":"Application to series organization.","body":"(1) In this section:\n(a) \"Protected series\" means an arrangement, however denominated, created by a\nseries organization that, pursuant to the law under which the series\norganization is organized, has the characteristics set forth in paragraph (b) of\nthis subsection; and\n(b) \"Series organization\" means an organization that, pursuant to the law under\nwhich it is organized, has the following characteristics:\n1. The organic record of the organization provides for creation by the\norganization of one (1) or more protected series, however  denominated,\nwith respect to specified property of the organization, and for records to\nbe maintained for each protected series that identify the property of, or\nassociated with, the protected series;\n2. Debt incurred or existing with respect to the activ ities of, or property of,\nor associated with, a particular protected series is enforceable against the\nproperty of, or associated with, the protected series only, and not against\nthe property of, or associated with, the organization or other protected\nseries of the organization; and\n3. Debt incurred or existing with respect to the activities or property of the\norganization is enforceable against the property of the organization only,\nand not against the property of, or associated with, a protected series of\nthe organization.\n(2) A series organization and each protected series of the organization is a separate\nperson for purposes of this chapter, even if for other purposes a protected series is\nnot a person separate from the organization or other protected se ries of the\norganization.","path":["KRS Chapter 378A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44731","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"0710ecc0860acc93bf2a90c9e933ed6967415097cf2db3ebec7396c5455e369b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-378a.100","next":"us-ky/krs-378a.120"},"notice":"GroundRules: Original legal text.
