{"data":{"id":"us-ky/krs-38.040","jurisdiction":"us-ky","citation":"KRS 38.040","heading":"Appointment of officers and warrant officers -- Staff officers -- Conformity","body":"with federal standards.\n(1) All commissioned officers and warrant officers of the Kentucky National Guard\nshall be appointed by the Governor, upon the recommendation of the ad jutant\ngeneral and the commanding officers of the organizations to which such officers are\nto be assigned for duty, and shall be appointed according to grade in the branch or\ncorps of the service in which they are appointed. No officer or warrant officer s hall\nbe appointed unless he is eighteen (18) years of age or older and until he shall have\nsuccessfully passed such tests as to his physical, moral and professional fitness as\nare or shall be prescribed by federal law for federal recognition as an officer.\n(2) All appointments as staff officers shall be of individuals with previous military\nexperience.\n(3) The Governor may issue such regulations governing the appointment of\ncommissioned officers and warrant officers in the Kentucky National Guard as may\nbe necessary in order to conform to the requirements made by Congress for\nparticipation in federal appropriations for the Kentucky National Guard.\n(4) No officer or warrant officer except the adjutant general shall retain the grade to\nwhich he may have been a ppointed or promoted unless, within a reasonable length\nof time, he obtains federal recognition for such grade.","path":["KRS Chapter 38"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21528","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:55Z","sha256":"82a957d99bdbc2a759dffadc9e03eeb60cef46b6130a45f941b277b81e9f34e6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-38.030","next":"us-ky/krs-38.050"},"notice":"GroundRules: Original legal text.
