{"data":{"id":"us-ky/krs-38.090","jurisdiction":"us-ky","citation":"KRS 38.090","heading":"Enlistment in Kentucky National Guard -- Oath -- Transfer -- Extension of","body":"enlistments.\n(1) All able-bodied citizens of the United States, of good character, who can read and\nwrite the English language, who are between the ages of seventeen (17) and thi rty-\nfive (35) years with no prior service; between thirty -six (36) and under thirty -eight\n(38) with one (1) year of service; thirty-eight (38) and under forty-one (41) with two\n(2) years of service and forty-one (41) and under fifty-seven (57) with two (2) years\nplus the number of years applicant is over age forty (40), and who have passed the\nrequired physical examination and who are not ineligible for enlistment or\nreenlistment in the Armed Forces of the United States, subject to current United\nStates Arm ed Forces regulations covering enlistments and reenlistments, may be\nenlisted or reenlisted in the Kentucky National Guard for a term of one (1) or more\nyears.\n(2) No person dishonorably discharged or discharged without honor from the Armed\nForces of the United States shall be eligible for enlistment in the Kentucky National\nGuard.\n(3) Every person who enlists, extends his enlistment or reenlists shall sign and make\noath to an enlistment paper before any officer from any branch of the armed\nservices authorized to administer oaths.\n(4) Enlisted persons may be transferred to or from organizations, as provided by\nregulations.\n(5) By order of the Governor in case of emergency, enlistments in the Kentucky\nNational Guard may be extended for one (1) year.","path":["KRS Chapter 38"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21533","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:56Z","sha256":"893d8edbfff68ab8ee90c9ebf9f7e81bf12dad1654c1779a5ac97173a5c10cad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-38.080","next":"us-ky/krs-38.100"},"notice":"GroundRules: Original legal text.
