{"data":{"id":"us-ky/krs-38.990","jurisdiction":"us-ky","citation":"KRS 38.990","heading":"Penalties.","body":"(1) Any person who makes a false oath as to any statement contained in the enlistment\npapers mentioned in subsection (3) of KRS 38.090 shall be fined not less than ten\ndollars ($10) nor more than fifty dollars ($50).\n(2) Any civil officer who fails to execute process and sentences when required to do so\nunder KRS 38.400 shall be fined not more than fifty dollars ($50) for each offense.\n(3) Any master, keeper, or other person in charge of a tollgate, toll bridge, or ferry who\nwillfully hinders or delays any memb er of the Kentucky National Guard or\nKentucky active militia going to or returning from any parade, encampment, drill, or\nmeeting which he is required by proper authority to attend, or who refuses free\npassage to any member, conveyance, or other property i n violation of KRS 38.430\nshall be fined not more than fifty dollars ($50) for each offense.\n(4) Any person who violates any of the provisions of KRS 38.440 shall be fined not\nless than ten dollars ($10) nor more than one hundred dollars ($100), or impriso ned\nin the county jail for not more than six (6) months, or both.\n(5) Any person who violates any of the provisions of KRS 38.450 shall be fined not\nless than ten dollars ($10) nor more than one hundred dollars ($100).\n(6) Any person who violates any of th e provisions of subsection (1) of KRS 38.460 or\nwho aids in enforcing any provision prohibited by subsection (2) of KRS 38.460\nshall be fined not less than one hundred dollars ($100) or more than five hundred\ndollars ($500) or imprisoned in the county jail not less than six (6) months, or both.\n(7) Any person who trespasses upon property occupied by the Kentucky National\nGuard or Kentucky active militia contrary to the orders of the officer in charge of\nsuch property shall be fined not less than one hundred  dollars ($100) nor more than\nfive hundred dollars ($500) or imprisoned in the county jail for six (6) months, or\nboth.\n(8) Any witness who refuses to appear in answer to a subpoena, to answer questions\nbefore a military court or board is guilty of contemp t and may be fined not more\nthan fifty dollars ($50) by such court or board.\n(9) Any employer failing to meet any requirements of KRS 38.238 shall be guilty of a\nClass A misdemeanor.","path":["KRS Chapter 38"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=21579","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:56Z","sha256":"21ee529dedef5d3f72d34d5d0ff07ed1178f29c45491d144f4bf95114447081a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-38.510","next":"us-ky/krs-380.010"},"notice":"GroundRules: Original legal text.
