{"data":{"id":"us-ky/krs-380.060","jurisdiction":"us-ky","citation":"KRS 380.060","heading":"Person engaged in debt adjusting to contract with debtor -- Disclosure and","body":"notice to debtor -- Debtor's right to cancel.\n(1) A person engaged in debt adjusting shall contract in writing with the debtor and\nobtain the debtor's signature on the contract which shall designate the date on which\nthe debtor actually signs the contract as the date of the transaction and fully disclose\nthe exact nature of the debt -adjusting services and the total amount and terms of\ncompensation.\n(2) Any debtor entering into a  contract to provide debt -adjusting services shall have a\nright to cancel the contract until midnight of the fourteenth day after the day on\nwhich the debtor signs a contract offer to enter into a contract for debt -adjusting\nservices, except as provided in subsection (7) of this section.\n(3) The following notice, printed in at least twelve (12) point boldface type and\ncompleted with the name and address of the debt adjuster, shall appear on the\ncontract under the conspicuous caption \"DEBTOR'S RIGHT TO CANCE L\" and\nshall read as follows:\nNOTICE OF CANCELLATION\n.......................................................\n(enter date of transaction)\nYou may cancel this contract or offer without penalty or monetary obligation,\nwithin fourteen (14) days from the ab ove date. To cancel this transaction, you\nmay use any of the following methods: mail or otherwise deliver a signed and\ndated copy of this cancellation notice, or any other written notice of\ncancellation which you sign and date to (enter physical address of  debt\nadjuster) or e-mail a notice of cancellation to (enter name of debt adjuster) at\n(enter e-mail address of debt adjuster) not later than midnight of (enter date\nfourteen (14) days after transaction date).\nI hereby cancel this transaction.\n........................................................\n(Date)\n........................................................\n(Debtor's Signature)\n(4) Cancellation occurs when the debtor gives written notice of cancellation to the debt\nadjuster at the physical or e -mail address stated in the contract or offer to perform\nservices.\n(5) Notice of cancellation, if given by mail, is given when it is deposited in a mailbox\nproperly addressed and postage prepaid and, if given by e -mail, when the debtor\nsends the e-mail.\n(6) Notice of cancellation given by the debtor is sufficient if it indicates in writing the\nintention of the debtor not to be bound by the contract or offer of services.\n(7) Until the debt adjuster has complied with the disclosure notice required by\nsubsection (3) of this section, the debtor may cancel the contract or offer of services\nby notifying the debt adjuster of his or her intention to cancel.","path":["KRS Chapter 380"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35383","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"a1bd8bb6321a18a03f0759d48ccc6a6a1f6126b1e7932896ae84869b5171d34f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-380.050","next":"us-ky/krs-380.070"},"notice":"GroundRules: Original legal text.
