{"data":{"id":"us-ky/krs-380.110","jurisdiction":"us-ky","citation":"KRS 380.110","heading":"Cause of action for loss resulting from violation of KRS Chapter 380 --","body":"Time limitation on prosecution of action.\n(1) Any person who enters into a debt -adjusting transaction and thereby suffers any\nascertainable loss of money or property, real or personal, as a result of a violation of\nthis chapter, may bring an action under the Rules of Civil Procedure in the Circuit\nCourt in which the person resides or where the transaction in question occurred, to\nrecover actual damages. The court may, in its discre tion, award actual damages and\nmay provide such equitable relief as it deems necessary or proper. Nothing in this\nsection shall be construed to limit a person's right to seek punitive damages where\nappropriate.\n(2) Upon commencement of any action brought under subsection (1) of this section, the\nclerk of the court shall mail a copy of the complaint or other initial pleading to the\nAttorney General and, upon entry of any judgment or decree in the action, shall mail\na copy of such judgment to the Attorney General.\n(3) In any action brought by a person under this section, the court may award to the\nprevailing party, in addition to the relief provided in this section, reasonable\nattorney's fees and costs.\n(4) Any person bringing an action under this section shal l bring such action within one\n(1) year after any action of the Attorney General has been terminated or within two\n(2) years after the violation of this chapter, whichever is later.","path":["KRS Chapter 380"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35388","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:09Z","sha256":"930dfcc15d7a6d09ba41c28d71d7497e1a35d7ffb1288501b7c6e397b36a059f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-380.100","next":"us-ky/krs-380.120"},"notice":"GroundRules: Original legal text.
