{"data":{"id":"us-ky/krs-381.136","jurisdiction":"us-ky","citation":"KRS 381.136","heading":"Life tenants and their descendants -- Partition.","body":"(1) Where the land is held under a deed or will vesting a life estate in two (2) or more\npersons or in trust for their benefit, with remainder as to the share of each to his or\nher children or descendants, it shall be lawful for a court of equity, on the petition of\none (1) of such life tenants and his or her children or descendants who would then\nbe entitled to such remainder, all persons having interests in such lands being made\nparties, to partition such land so as to set apart to such life tenants and child ren or\ndescendants so much of said land to which they shall be entitled in severalty; and to\nthat alone shall attach the title or interest of after -born children or descendants in\nwhom, by the terms of said deed or will, such a remainder would vest.\n(2) Where part of the land so held shall be situated in this state and part in another state,\nthe court may, in making partition, take into consideration the value of all of said\nland, and set apart to those resident in this state land in this state equal to th eir full\nshare of all said land, securing, by proper deeds and orders to the nonresidents,\nrelease of the interest of such residents in the lands in the other state or territory.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35406","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:10Z","sha256":"a19e062cd046b720ef414738454d049f847f7708bfbf3105ea6231f75ae61097","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.135","next":"us-ky/krs-381.140"},"notice":"GroundRules: Original legal text.
