{"data":{"id":"us-ky/krs-381.260","jurisdiction":"us-ky","citation":"KRS 381.260","heading":"Grants-in-aid of charity valid.","body":"(1) Every grant, conveyance, legacy, bequest, devise, gift, appointment, assignment and\ntransfer of property, whenever made and in whatever form, shall be valid (a) if\nmade to any corporation, association, trust, foundation, or similar organization or\nentity, created or formed for and devoted solely to charitable, religious, scientific,\nliterary, educational, humane, benevolent or like purposes or, (b) except as\notherwise provided by statute, if it is made for any charitable or humane purpose\nand if it points o ut with reasonable certainty the purposes of the charity and the\nbeneficiaries thereof.\n(2) A grant, conveyance, legacy, bequest, devise, gift, appointment, assignment and\ntransfer of property, whenever made and in whatever form, is deemed to point out\nwith reasonable certainty the purposes of the charity and beneficiaries thereof if and\nso long as the same is to or for the use of any corporation, trust, community chest,\nfund, foundation, or other entity organized and operated exclusively for religious,\ncharitable, scientific, literary, or educational purposes, including the encouragement\nof art and the prevention of cruelty to children or animals, no part of the net\nearnings of which inures to the benefit of any private stockholder or individual\n(except as reasonable compensation for services rendered), and no substantial part\nof the activities of which is carrying on propaganda, or otherwise attempting, to\ninfluence legislation, and which does not participate in, or intervene in (including\nthe publishing o r distributing of statements), any political campaign on behalf of\nany candidate for public office, even though such corporation, trust, fund,\nfoundation or other entity is authorized to apply the trust income or property to any\nclass or classes of charita ble purposes mentioned above and the trustee or other\nmanaging individual or body is able and willing to make the selection.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35432","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:10Z","sha256":"1ce06e4fd3551e326b6a45dace6e6822231da0686e80954a3e114966419507f1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.250","next":"us-ky/krs-381.270"},"notice":"GroundRules: Original legal text.
