In case the jury first summoned fails to attend, or, after being s worn, fails to\nagree and render their verdict, the court shall summon another jury, on a day to be named\nin his mandate in writing. The court shall make out and return to the clerk's office from\nwhich the writ issued, a complete record of the proceedings b efore him, together with the\noriginal writ, the verdict, and assessment of the jury, certified by him.
