{"data":{"id":"us-ky/krs-381.697","jurisdiction":"us-ky","citation":"KRS 381.697","heading":"Cemeteries maintained by legal owners.","body":"(1) Every cemetery in Kentucky except private family cemeteries shall be maintained\nby its legal owner or owners, without respect to the individual owners of burial\nplots in the cemetery, in such a manner so as to keep the burial grounds or cemetery\nfree of gr owth of weeds, free from accumulated debris, displaced tombstones, or\nother signs and indication of vandalism or gross neglect.\n(2) The owner or owners of public or private burial grounds, regardless of size or\nnumber of graves, shall protect the burial grounds from desecration or destruction as\nstipulated in KRS 525.115(1)(a), (b), or (c) or from being used for dumping\ngrounds, building sites, or any other use which may result in the burial grounds\nbeing damaged or destroyed. The provisions of this subsection shall not apply to the\nowner or owners of public or private burial grounds when the public or private\nburial grounds have been desecrated, damaged, or destroyed as the result of a crime\nby another as defined by KRS 500.080.\n(3) The owner or owners of p rivate burial grounds shall be required to construct\ncemetery protection structures only if the burial ground is located in a county with a\ncounty cemetery board and if the board provides compensation to the private burial\nground owner for supplies, labor,  and other expenses associated with such\nconstruction.\n(4) The governing authorities of any city within whose corporate limits any public or\nprivate burial grounds lie may require the owner or those having claims to the\ngrounds to properly care for them.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44961","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:10Z","sha256":"61bdb213a1ca7167621a06c56f9ff145bf01d6e255652f104933772a1570c5cd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.695","next":"us-ky/krs-381.700"},"notice":"GroundRules: Original legal text.
