{"data":{"id":"us-ky/krs-381.755","jurisdiction":"us-ky","citation":"KRS 381.755","heading":"Removal of grave or cemetery on application of landowner or county --","body":"Procedure -- Expenses.\n(1) Upon application of the owner of property upon which is located an abandoned\ngrave or cemetery or whenever the fiscal court of any county deems it to be i n the\nbest interest of the county to remove and relocate any such grave or cemetery the\ncourt may issue an order or resolution authorizing such removal or relocation.\n(2) The order or resolution for the removal and relocation of the grave or cemetery\npursuant to subsection (1) shall specify and declare that at any time after the\nexpiration of sixty (60) days after the first publication of notice of such intended\naction pursuant to KRS Chapter 424, the court shall direct the removal and\nrelocation of the grave or cemetery.\n(3) Expenses for removal and relocation of any grave or cemetery under the provisions\nof this section shall be paid by the individual requesting such removal or if the\nremoval is made in the best interest of the county the expenses shall be  paid from\ncounty funds.\n(4) Any grave or cemetery removed under the provisions of this section shall be\nrelocated in a suitable place at the expense of the person or county requesting such\nremoval and relocation.\n(5) For the purposes of this section a gra ve or cemetery shall be considered abandoned\nwhen left untended for a period of ten (10) years preceding the date of the resolution\nfor removal and relocation of the grave or cemetery.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35488","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:11Z","sha256":"2b653d840870267f0672de869defa3557cf4e50d287e07d94d8bbdc23e452bbd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.750","next":"us-ky/krs-381.760"},"notice":"GroundRules: Original legal text.
