{"data":{"id":"us-ky/krs-381.791","jurisdiction":"us-ky","citation":"KRS 381.791","heading":"Amendment of declaration -- Termination of declaration and association --","body":"Amendment of bylaws.\n(1) Unless otherwise specified in the declaration, the owners may amend the\ndeclaration by consent of eighty percent (80%) of the owners of all lot s in the\nplanned community either in writing or in a special meeting called for that purpose.\nExcept for any declaration that was created after June 29, 2023, this subsection\nshall not apply to amending the declaration when it is silent as to how an\namendment is to occur. No amendment to the declaration shall be effective until\nfiled with the county clerk.\n(2) Unless otherwise specified in the declaration, the owners may terminate the\ndeclaration and the association by the written consent of not less than eighty percent\n(80%) of the owners of all lots in the planned community. Except for any\ndeclaration that was created after June 29, 2023, this subsection shall not apply to\nterminating the declaration when it is silent as to how a termination is to occur.
