{"data":{"id":"us-ky/krs-381.837","jurisdiction":"us-ky","citation":"KRS 381.837","heading":"Master deed exceptions.","body":"If a condominium does not contain any unit which is designed for occupancy by\nonly one family or household, or if the floor area of all those units which are designed for\noccupancy by only one (1) family or household does not in the aggregate exceed ten\npercent (10%) of the floor area of all units in the condominium, then the following\nprovisions shall be applicable, notwithstanding any other provisions of this chapter:\nThe master deed may provide:\n(1) That to any extent specified in the master deed the co mmon profits shall be\ndistributed among, and the common expenses shall be charged to, the unit owners in\nproportions other than according to their respective percentages of the undivided\ninterest in the common areas and facilities;\n(2) That to any extent s pecified in the master deed the unit owners shall not be\npersonally liable for sums assessed for their share of common expenses, but such\nprovisions shall not adversely affect any lien for said share;\n(3) That the priority provided in KRS 381.883 shall not  prohibit subordination of a\nmortgage lien to the lien for common expenses;\n(4) A procedure for submitting the disputes arising from the administration of the\ncondominium to arbitration or other impartial determination; and\n(5) Terms and conditions differi ng from those set forth in KRS 381.830 or 381.890\nregarding rebuilding made necessary by fire or other casualty loss, the making of\nimprovements and allocation of the costs of such rebuilding or improvements, and\nthe removal of the condominium or portion t hereof from the provisions of this\nchapter; and in such case, the terms and conditions of the master deed shall take\nprecedence over the provisions of KRS 381.830 or 381.890 to the extent they are\ninconsistent.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35503","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:11Z","sha256":"ea485a09b21fe120d592a306a65f4c0710aaaf99bcaf723b12e6cb02937ca115","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.835","next":"us-ky/krs-381.840"},"notice":"GroundRules: Original legal text.
