{"data":{"id":"us-ky/krs-381.9127","jurisdiction":"us-ky","citation":"KRS 381.9127","heading":"Unit boundaries.","body":"(1) If walls, floors, or ceilings are designated as boundaries of a unit, all lath, furring,\nwallboard, plasterboard, plaster, paneling, tiles, wallpaper, paint, finished flooring,\nand any other materials constituting any part of the finished surfaces thereof are a\npart of the unit, and all other portions of the walls, floors, or ceilings are a part of\nthe common elements unless otherwise specified in the declaration.\n(2) If any chute, flue, duct, wire, conduit, heating system, air conditioning system,\nbearing wall, bearing column, or any other fixture lies partially within and partially\noutside the designated boundaries of a unit, any portion thereof serving only that\nunit is a limited common element allocated solely to that unit, and any portion\nthereof serving more than one (1) unit or any portion of the common elements is a\npart of the common elements unless otherwise specified in the declaration.\n(3) Subject to subsection (2) of this section, all spaces, interior partitions, and other\nfixtures and improvements within the boundaries of a unit are a part of the unit.\n(4) Any shutters, awnings, window boxes, doorsteps, stoops, porches, balconies, patios,\nand all exterior doors and windows or other fixtures designed to serve a single unit,\nbut located outside the  unit's boundaries, are limited common elements allocated\nexclusively to that unit.\n(5) Any sprinkler system, alarm system, or other system of protection that serves more\nthan one (1) unit, unless all units served are owned by the same owner, shall be part\nof the common elements.\n(6) All interior hallways, stairways, and other interior space, including all fixtures\nlocated within these spaces, that are located outside of a unit shall be limited\ncommon elements allocated exclusively to the units appurtenant to or otherwise\naccessible from such interior spaces.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36830","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:11Z","sha256":"75533adab41a3c7252e1d25485e48aec476927af8b1327e8d96064b07e00fcee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9125","next":"us-ky/krs-381.9129"},"notice":"GroundRules: Original legal text.
