{"data":{"id":"us-ky/krs-381.9133","jurisdiction":"us-ky","citation":"KRS 381.9133","heading":"Contents of declaration.","body":"(1) The declaration for a condominium shall contain:\n(a) The name of the condominium which shall include the word \"condominium\"\nor be followed by the words \"a condominium,\" and the association;\n(b) The name of every county in which any part of the condominium is situated;\n(c) A legally sufficient description of the real estate included in the\ncondominium;\n(d) A statement of the maximum number of units which the declarant reserves the\nright to create;\n(e) A description of the boundaries of each unit created by t he declaration,\nincluding the unit's identifying number;\n(f) A description of any limited common elements as provided in KRS\n381.9141(2)(h), except for those limited common elements specified in KRS\n381.9127(2), (4), and (6);\n(g) A description of any real estate, except real estate subject to development\nrights, which may be allocated subsequently as limited common elements,\nother than limited common elements specified in KRS 381.9127(2), (4), and\n(6), together with a statement that they may be so allocated;\n(h) A description of any development rights and other special declarant rights\nreserved by the declarant, together with a legally sufficient description of the\nreal estate to which each of those rights applies, and a time limit within which\neach of those rights must be exercised;\n(i) If any development right may be exercised with respect to different parcels of\nreal estate at different times, a statement to that effect together with:\n1. a. A statement fixing the boundaries of those portions and identifying\nthe proposed order in which those portions may be subjected to the\nexercise of each development right; or\nb. A statement that no assurances are made concerning the\nboundaries or order in which the exercise of development rights\nmay occur; and\n2. A statement as to whether, if any development right is exercised in any\nportion of the real estate subject to that development right, that\ndevelopment right must be exercised in all or in any other portion of the\nremainder of that real estate;\n(j) Any othe r conditions or limitations under which the rights described in\nparagraph (i) of this subsection may be exercised or will lapse;\n(k) An allocation to each unit of the allocated interests in the manner described in\nKRS 381.9137;\n(l) Any restrictions on use, occupancy, and alienation of the units;\n(m) The recording data for recorded easements and licenses appurtenant to or\nincluded in the condominium or to which any portion of the condominium is\nor may become subject by virtue of a reservation in the declaration; and\n(n) All matters required by KRS 381.9135, 381.9137, 381.9139, 381.9141,\n381.9153, and 381.9169(4).\n(2) The declaration may contain any other matters the declarant deems appropriate.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36832","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:11Z","sha256":"fbab7478c63e064b2e74f0dd0c21ce9d8543e23b95b0c3d99c4502ae8e226105","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9131","next":"us-ky/krs-381.9135"},"notice":"GroundRules: Original legal text.
