{"data":{"id":"us-ky/krs-381.9155","jurisdiction":"us-ky","citation":"KRS 381.9155","heading":"Amendment of declaration.","body":"(1) Except in cases of amendments that may be executed by a declarant under KRS\n381.9141(6) or 381.9143; the association under KRS 381.9113, 381.9135(4),\n381.9139(3), 381.9147(1), or 381.9149; or certain unit owners under KRS\n381.9139(2), 381.9147(1), or 381.9 149(2), and except as limited by subsection (4)\nof this section and KRS 381.9187(6), the declaration, including the plats and plans,\nmay be amended only by vote or agreement of unit owners of units to which at least\nsixty-seven percent (67%) of the votes i n the association are allocated, or any larger\nmajority specified in the declaration. The declaration may specify a smaller number\nonly if all of the units are restricted exclusively to nonresidential use.\n(2) An action to challenge the validity of an amen dment adopted by the association\npursuant to this section shall not be brought more than one (1) year after the\namendment is recorded.\n(3) Every amendment to the declaration shall be recorded in every county in which any\nportion of the condominium is locat ed, and is effective only upon recordation. An\namendment shall be indexed in the name of the condominium and the association\nand in the name of the parties executing the amendment.\n(4) Except to the extent expressly permitted or required by other provision s of KRS\n381.9101 to 381.9207, an amendment shall not create or increase special declarant\nrights, increase the number of units, change the boundaries of any unit, the allocated\ninterests of a unit, or the uses to which any unit is restricted, in the absen ce of\nunanimous consent of the unit owners.\n(5) Amendments to the declaration required by KRS 381.9101 to 381.9207 to be\nrecorded by the association shall be prepared, executed, recorded, and certified on\nbehalf of the association by any officer of the ass ociation designated for that\npurpose or, in the absence of designation, by the president of the association.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40019","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:11Z","sha256":"c74a6ef827a1d1196df64ed09b517ddf4f8070db1c8830f2c3ac60e6da26f8ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9153","next":"us-ky/krs-381.9157"},"notice":"GroundRules: Original legal text.
