{"data":{"id":"us-ky/krs-381.9161","jurisdiction":"us-ky","citation":"KRS 381.9161","heading":"Master associations.","body":"(1) If the declaration for a condominium provides that any of the powers described in\nKRS 381.9167 are to be exercised by or may be delegated to a for -profit or\nnonprofit corporation or unincorporated association which exercises those or other\npowers on behalf  of one (1) or more condominiums or for the benefit of the unit\nowners of one (1) or more condominiums, all provisions of KRS 381.9101 to\n381.9207 applicable to unit owners' associations apply to any such corporation or\nunincorporated association, except as modified by this section.\n(2) Unless a master association is acting in the capacity of an association described in\nKRS 381.9165, it may exercise the powers set forth in KRS 381.9167(1)(b) only to\nthe extent expressly permitted in the declarations of cond ominiums which are part\nof the master association or expressly described in the delegations of power from\nthose condominiums to the master association.\n(3) If the declaration of any condominium provides that the executive board may\ndelegate certain powers to a master association, the members of the executive board\nhave no liability for the acts or omissions of the master association with respect to\nthose powers following delegation.\n(4) The rights and responsibilities of unit owners with respect to the unit  owners'\nassociation set forth in KRS 381.9169, 381.9177, 381.9179, 381.9181, and\n381.9185 apply in the conduct of the affairs of a master association only to those\npersons who elect the board of a master association, whether or not those persons\nare otherwise unit owners within the meaning of KRS 381.9101 to 381.9207.\n(5) Notwithstanding the provisions of KRS 381.9169(6) with respect to the election of\nthe executive board of an association by all unit owners after the period of declarant\ncontrol ends and e ven if a master association is also an association described in\nKRS 381.9165, the certificate of incorporation or other instrument creating the\nmaster association and the declaration of each condominium the powers of which\nare assigned by the declaration o r delegated to the master association may provide\nthat the executive board of the master association shall be elected after the period of\ndeclarant control in any of the following ways:\n(a) All unit owners of all condominiums subject to the master associat ion may\nelect all members of that executive board;\n(b) All members of the executive boards of all condominiums subject to the\nmaster association may elect all members of that executive board;\n(c) All unit owners of each condominium subject to the master as sociation may\nelect specified members of that executive board; or\n(d) All members of the executive board of each condominium subject to the\nmaster association may elect specified members of that executive board.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36847","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"4a3f51cda247f18fbc7989b153dcad5b09572715baf0f5daff430dc2eb1d1104","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9159","next":"us-ky/krs-381.9163"},"notice":"GroundRules: Original legal text.
