{"data":{"id":"us-ky/krs-381.9163","jurisdiction":"us-ky","citation":"KRS 381.9163","heading":"Merger or consolidation of condominiums.","body":"(1) Any two (2) or more condominiums by agreement of the unit owners as provided in\nsubsection (2) of this section, may be merged or consolidated into a single\ncondominium. In the event of a merger or consolidation, unless the agreement\notherwise provides, the  resultant condominium is, for all purposes, the legal\nsuccessor of all of the pre -existing condominiums and the operations and activities\nof all associations of the pre -existing condominiums shall be merged or\nconsolidated into a single association which shall hold all powers, rights,\nobligations, assets, and liabilities of all pre-existing associations.\n(2) In addition to any other requirements of the declaration, the merger or consolidation\nof two (2) or more condominiums pursuant to subsection (1) of th is section shall be\nevidenced by a recorded agreement duly executed by the president of the association\nof each of the pre -existing condominiums following approval by owners of units to\nwhich are allocated the percentage of votes in each condominium requir ed to\nterminate that condominium. Any such agreement shall be recorded in every county\nin which a portion of the condominium is located and is not effective until recorded.\n(3) Every merger or consolidation agreement shall provide for the reallocation of t he\nallocated interests in the new association among the units of the resultant\ncondominium either:\n(a) By stating the reallocations or the formulas upon which they are based; or\n(b) By stating the percentage of overall allocated interests of the new\ncondominium which are allocated to all of the units comprising each of the\npre-existing condominiums, and providing that the portion of the percentages\nallocated to each unit formerly comprising a part of the pre -existing\ncondominium shall be equal to the percen tages of allocated interests allocated\nto that unit by the declaration of the pre-existing condominium.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36844","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"f7476d1bc051e7d99fc7c5a315ab7dafcdc3318d257ce51712cfb9bbfe6e2082","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9161","next":"us-ky/krs-381.9165"},"notice":"GroundRules: Original legal text.
