{"data":{"id":"us-ky/krs-381.9181","jurisdiction":"us-ky","citation":"KRS 381.9181","heading":"Voting -- Proxies.","body":"(1) If only one (1) of the multiple owners of a unit is present at a meeting of the\nassociation, he or she is entitled to cast all the votes allocated to that unit. If more\nthan one (1) of the multiple owners of a unit are present, the votes allocated to that\nunit may be cast only in accordance with the agreement of a majority in interest of\nthe multiple owners, unless the declaration expressly provides otherwise. There is\nmajority agreement if any one (1) of the multiple owners casts the votes allocated to\nthat unit without protest being made promptly to the person presiding over the\nmeeting by any of the other owners of the unit.\n(2) Votes allocated to a unit may be cast pursuant to proxy duly executed by a unit\nowner. If a unit is owned by more than one (1) p erson, each owner of the unit may\nvote or register protest to the casting of votes by the other owners of the unit\nthrough a duly executed proxy. A unit owner may not revoke a proxy given\npursuant to this section, except by actual notice of revocation to t he person\npresiding over a meeting of the association. A proxy is void if it is not dated or\npurports to be revocable without notice. A proxy terminates one (1) year after its\ndate, unless it specifies a shorter term.\n(3) If the declaration requires that votes on specified matters affecting the condominium\nbe cast by lessees rather than unit owners of leased units:\n(a) Subsections (1) and (2) of this section apply to lessees as if they were unit\nowners;\n(b) Unit owners who have leased their units to other p ersons shall not cast votes\non those specified matters;\n(c) Lessees are entitled to notice of meetings, access to records, and other rights\nrespecting those matters as if they were unit owners; and\n(d) Unit owners shall also be given notice, as provided in  KRS 381.9177, of all\nmeetings at which lessees may be entitled to vote.\n(4) No votes allocated to a unit owned by the association may be cast.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36856","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"123f678dbf91c0cd9c07f5009cf731bde329da96da342249d71110279dbb0b82","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9179","next":"us-ky/krs-381.9183"},"notice":"GroundRules: Original legal text.
