{"data":{"id":"us-ky/krs-381.9191","jurisdiction":"us-ky","citation":"KRS 381.9191","heading":"Assessments for common expenses.","body":"(1) Until the association makes a common expense assessment, the declarant shall pay\nall common expenses. After any assessment has been made by the association,\nassessments shall be made at least annually and based on a budget adopted at least\nannually by the association.\n(2) Except for assessments under subsections (3), (4), and (5) of this section, all\ncommon expenses shall be assessed against all the units in accordance with the\nallocations set forth in the declaration pursuant to KRS 381.9137(1). Any past d ue\ncommon expense assessment or installment thereof shall bear interest at the rate\nestablished by the association not exceeding eighteen percent (18%) per year.\n(3) To the extent required by the declaration:\n(a) Any common expense associated with the maintenance, repair, or replacement\nof a limited common element shall be assessed against the units to which that\nlimited common element is assigned, equally, or in any other proportion that\nthe declaration provides;\n(b) Any common expense or portion thereof b enefiting fewer than all of the units\nshall be assessed exclusively against the units benefited; and\n(c) The costs of insurance shall be assessed in proportion to risk and the costs of\nutilities shall be assessed in proportion to usage.\n(4) Assessments may be made to pay a judgment against the association and, if made,\nshall only be made against the units in the condominium at the time the judgment\nwas entered, in proportion to their common expense liabilities.\n(5) If any common expense is caused by the mis conduct of any unit owner, the\nassociation may assess that expense exclusively against his or her unit.\n(6) If common expense liabilities are reallocated, common expense assessments and\nany installment thereof not yet due shall be recalculated in accordanc e with the\nreallocated common expense liabilities.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36859","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"1ed284685d05d1f05a07ca9bcc8db892942721dc9df7fcf2133f00a4225c1c94","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9189","next":"us-ky/krs-381.9193"},"notice":"GroundRules: Original legal text.
