{"data":{"id":"us-ky/krs-381.9201","jurisdiction":"us-ky","citation":"KRS 381.9201","heading":"Applicability of KRS 381.9201, 381.9205, and 381.9207 -- Modification or","body":"waiver by agreement -- Certificate not required in certain cases.\n(1) This section and KRS 381.9205 and 381.9207 apply to all units subject to KRS\n381.9101 to 381.9207, except a s provided in subsection (2) of this section or as\nmodified or waived by agreement of purchasers of units in a condominium in which\nall units are restricted to nonresidential use.\n(2) The certificate referred to in KRS 381.9203 shall not be required in the case of:\n(a) A gratuitous disposition of a unit;\n(b) A disposition pursuant to court order;\n(c) A disposition by a government or governmental agency;\n(d) A disposition by foreclosure or deed in lieu of foreclosure;\n(e) A disposition to a person in the bus iness of selling real estate who intends to\noffer those units to purchasers, and where the purchaser has modified or\nwaived the requirements of KRS 381.9203 by agreement; or\n(f) A disposition that may be canceled at any time and for any reason by the\npurchaser without penalty.","path":["KRS Chapter 381"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40016","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"ba342328e9a9319ac54f9c1867778946359bb8e1e22a1b6e427827615298a3d5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-381.9199","next":"us-ky/krs-381.9203"},"notice":"GroundRules: Original legal text.
