{"data":{"id":"us-ky/krs-382.075","jurisdiction":"us-ky","citation":"KRS 382.075","heading":"Uniform Real Property Electronic Recording Act -- Recording of","body":"electronic document -- Electronic signature -- Powers and duties of county\nclerk.\n(1) If a law requires, as a condition for recording by the county clerk upon the records\nrelating t o real property, that a document be an original, be on paper or another\ntangible medium, or be in writing, the requirement shall be satisfied by an electronic\ndocument that complies with the requirements of KRS 423.300 to 423.455 or this\nsection.\n(2) If a law requires, as a condition for recording, that a document be signed, the\nrequirement is satisfied by an electronic signature.\n(3) A requirement that a document or a signature associated with a document be\nnotarized, acknowledged, verified, witnessed, or made under oath is satisfied if the\nelectronic signature of the person authorized to perform that act, and all other\ninformation required to be included, is attached to or logically associated with the\ndocument or signature. A physical or electronic image of a stamp, impression, or\nseal need not accompany an electronic signature.\n(4) As used in this section, \"paper document\" means a document that is received by the\nclerk in a form that is not electronic. A clerk:\n(a) May receive, index, store, archive, and transmit electronic documents;\n(b) May provide for access to, and search and retrieval of, documents and\ninformation by electronic means;\n(c) Who accepts electronic documents for recording shall continue to accept\npaper documents as authorized by state law  and shall place entries for both\ntypes of documents in the same index;\n(d) May convert paper documents accepted for recording into electronic form;\n(e) May convert into electronic form information recorded before the clerk began\nto record electronic documents;\n(f) May accept electronically any fee, levy, or tax that the clerk is authorized to\ncollect; and\n(g) May agree with other officials of a state or a political subdivision of that state,\nor of the United States, on procedures or processes to facilitate  the electronic\nsatisfaction of prior approvals and conditions precedent to recording and the\nelectronic payment of fees, levies, and taxes that the clerk is authorized to\naccept.\n(5) This section shall be known and may be cited as the \"Uniform Real Proper ty\nElectronic Recording Act.\" In applying and construing this section, consideration\nshall be given to the need to promote uniformity of the law with respect to its\nsubject matter among the states that enact it.","path":["KRS Chapter 382"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49521","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"8967e1ee4aabdc0329fa60d1a5e6557530027999bd3bb81222ba87110f05c981","source_id":"us-ky","stale":false,"prev":"us-ky/krs-382.070","next":"us-ky/krs-382.076"},"notice":"GroundRules: Original legal text.
