{"data":{"id":"us-ky/krs-382.076","jurisdiction":"us-ky","citation":"KRS 382.076","heading":"Paper copy of electronic record relating to real property -- Certificate --","body":"Notice -- Exception for plats, maps, and surveys.\n(1) If a law requires that an instrument relating to real property within the\nCommonwealth, to be admitted to the publ ic record and recorded, be an original, be\non paper or another tangible medium, be in writing, or be signed, the requirement\nshall be satisfied by a paper copy of an electronic record, including an electronic\nrecord bearing an electronic signature, that a notary public has certified, pursuant to\nsubsection (3) of this section, to be a true and correct copy of the record that was\noriginally in electronic form and bearing an electronic signature.\n(2) A requirement that a document or a signature associated wit h a document be\nnotarized, acknowledged, verified, witnessed, or made under oath is satisfied by a\npaper copy of an electronic document bearing an electronic signature of the person\nauthorized to perform that act, and all other information required to be i ncluded,\nthat a notary public has certified, pursuant to subsection (3) of this section, to be a\ntrue and correct copy of a document that was originally in electronic form and\nbearing an electronic signature of the person. A physical or electronic image of  a\nstamp, impression, or seal need not accompany an electronic signature.\n(3) A county clerk shall record a paper copy of a document that was originally in\nelectronic form and that is otherwise entitled to be recorded under the laws of this\nstate, if the p aper copy has been certified to be a true and correct copy of the\nelectronic record by a notary public as evidenced by a certificate attached to or\nmade a part of the record. The certificate:\n(a) Shall:\n1. Be signed and dated by the notary public;\n2. Identify the jurisdiction in which the certification is performed;\n3. Contain the title of the notary public; and\n4. Indicate the number and date of expiration, if any, of the notary public's\ncommission; and\n(b) May include an official stamp of the notary publi c affixed to or embossed on\nthe certificate.\n(4) The following form of certificate is sufficient for the purposes of this section, if\ncompleted with the information required by subsection (3) of this section:\nState of___________________\n[County] of________________\nI certify that the foregoing and annexed document entitled______________\n[document title], dated__________________[document date, if applicable],\nand containing__________pages is a true and correct copy of an electronic\ndocument bearing one (1) or more electronic signatures.\nExecuted this___________________[date].\n___________________________________\n[Signature of notary public]\nStamp\n[_________________________________]\nNotary Public\n[My commission expires:_____________________]\n[My notary registration number is:_____________]\n(5) A notary public duly commissioned under the laws of this Commonwealth or of\nanother state within the United States has the authority to make the certification\nprovided in this section.\n(6) A notary public making the certification provided in this section shall:\n(a) Personally print or supervise the printing of the electronic document onto\npaper;\n(b) Not make any changes or modifications to the electronic document other than\nthe certification described in subsection (3) of this section; and\n(c) Confirm that the electronic document has been rendered tamper-evident.\n(7) If a certificate is completed with the information required by subsection (3) of this\nsection and is attached to or ma de a part of a paper record, the certificate shall be\nconsidered conclusive evidence that the requirements of this section have been\nsatisfied with respect to the record.\n(8) A record purporting to convey or encumber real property or any interest therein t hat\nhas been recorded by a clerk for the jurisdiction in which the real property is\nlocated, although the record may not have been certified in accordance with the\nprovisions of this section, shall import the same notice to third persons from the\ntime of r ecording as if the record had been certified in accordance with the\nprovisions of this section.\n(9) This section shall not apply to a plat, map, or survey of real property if under\nanother law of this state, or under a rule, regulation, or ordinance applic able to a\nclerk:\n(a) There are requirements of format or medium for the execution, creation, or\nrecording of the plat, map, or survey beyond the requirements applicable to a\ndeed to real property; or\n(b) The plat, map, or survey must be recorded in a diffe rent location than a deed\nto real property.","path":["KRS Chapter 382"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49522","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"73ba08cb95a32a461a07c1a5bbac2b9354e283f3e37707d36e9cdba122009ac1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-382.075","next":"us-ky/krs-382.077"},"notice":"GroundRules: Original legal text.
