{"data":{"id":"us-ky/krs-382.120","jurisdiction":"us-ky","citation":"KRS 382.120","heading":"Real property acquired by descent -- Requirements for conveyance of --","body":"Indexing -- Clerk's fees.\n(1) Before any deed to real property, the title to which has passed to the grantor under\nthe laws of descent, is filed for record the grantor or grantee, or the agent or attorney\nor either, shall present to the county clerk the affidavit of the grantor or any one (1)\nof the heirs at law or next of kin of the ancestor of the grantor, or of two (2)\nresidents of this state, each of whom has personal knowledge of the facts, which\naffidavit shall set forth:\n(a) The name of the ancestor;\n(b) The date of the ancestor's death;\n(c) Whether the ancestor was married or single, and if married, the name of the\nsurviving spouse and his or her address;\n(d) The place of  residence at the time of the ancestor's death, if known to the\naffiant or affiants;\n(e) The fact that the ancestor died intestate; and\n(f) The names, ages and addresses, so far as known or ascertainable, of each of\nsuch ancestor's heir at law and next o f kin, who by his death inherited such\nreal property, and the relationship of each to the ancestor and the interest in\nsuch real property inherited by each.\n(2) The affidavit shall be filed with the clerk of the county in which the real property is\nsituated, at or before the time when the deed or conveyance is filed with the clerk\nfor record, and shall be recorded in the record of deeds, and indexed in the general\nindex of deeds in the name of such ancestor as grantor, and in the name of each of\nsuch heirs at law or next of kin as grantees, in the same manner as if such names\noccurred in a deed of conveyance from the ancestor to the heirs at law. For indexing\nand recording the affidavit, the clerk shall receive the same fees as are allowed for\nrecording and indexing deeds.\n(3) No county clerk or deputy clerk shall receive or permit to be lodged for record any\nsuch deed until the affidavit has been presented to him, but nothing in this section\nshall prevent the recording from being legal of any such deed lod ged for record\nprior to the filing of the affidavit.","path":["KRS Chapter 382"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35591","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"37e53f47cf4c2b84859bd4b761da2d22bd98c95e78e5c2919a02300bd2887bcf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-382.115","next":"us-ky/krs-382.130"},"notice":"GroundRules: Original legal text.
