{"data":{"id":"us-ky/krs-382.135","jurisdiction":"us-ky","citation":"KRS 382.135","heading":"Statement of consideration or market value and mailing and in -care-of","body":"addresses required in deed to real property -- Exceptions -- Affidavit of\npersonal representative -- Clerk prohibited from filing noncompliant deed.\n(1) In addition to any ot her requirement imposed by law, a deed to real property shall\ncontain the following:\n(a) The full name of the grantor and grantee;\n(b) The mailing addresses of the grantor and grantee;\n(c) A statement of the full consideration;\n(d) A statement indicating the in-care-of address to which the property tax bill for\nthe year in which the property is transferred may be sent; and\n(e) 1. In the case of a transfer other than by gift, or with nominal or no\nconsideration a sworn, notarized certificate signed by the gr antor or his\nor her agent and the grantee or his or her agent, or the parent or guardian\nof a person under eighteen (18) years old, that the consideration reflected\nin the deed is the full consideration paid for the property; or\n2. In the case of a transfe r either by gift or with nominal or no\nconsideration, a sworn, notarized certificate signed by the grantor or his\nor her agent and the grantee or his or her agent, or the parent or guardian\nof a person under eighteen (18) years old, stating that the transf er is by\ngift and setting forth the estimated fair cash value of the property.\n(2) The deed filing requirements listed in subsection (1)(c), (d), and (e) of this section\nshall not apply to:\n(a) Deeds which only convey utility easements;\n(b) Deeds which tra nsfer property through a court action pursuant to a divorce\nproceeding;\n(c) Deeds which convey rights-of-way that involve governmental agencies;\n(d) Deeds which convey cemetery lots;\n(e) Deeds which correct errors in previous dee ds conveying the same property\nfrom the same grantor to the same grantee; or\n(f) Deeds which convey real property to a local airport board.\n(3) In the case of an exchange of properties, the fair cash value of the property being\nexchanged shall be stated in the body of the deed.\n(4) In the event of a transfer of property by will or under the laws of intestate\nsuccession, the personal representative of the estate, prior to closing out the estate,\nshall file an affidavit with the county clerk of each county in  which any of the\nproperty is located, which shall contain the following:\n(a) The names and addresses of the persons receiving each property passing by\nwill or intestate succession; and\n(b) The full or fair market value of each property as estimated or est ablished for\nany purpose in the handling of the estate, or a statement that no such values\nwere estimated or established.\n(5) No county clerk or deputy clerk shall lodge for record, and no county clerk or\ndeputy shall receive and permit to be lodged for re cord, any deed that does not\ncomply with the provisions of this section.\n(6) For purposes of subsection (1)(a) of this section, the full name of the grantor and\ngrantee shall be determined as follows:\n(a) As provided in KRS 355.9-503(1); or\n(b) For a business entity, it shall be synonymous with its real name determined as\nprovided in KRS 365.015(1)(b) and (c); or\n(c) For an individual, his or her surname and his or her first personal name or\ninitial, middle personal name or names, or initial or initials, or  any\ncombination thereof that includes the individual's surname.\n(7) The receipt for record and recording of any instrument by the county clerk not in\ncompliance with this section shall not prevent the record of filing of the instrument\nfrom becoming notice as otherwise provided by law, nor impair the admissibility of\nthe record as evidence.","path":["KRS Chapter 382"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47942","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:12Z","sha256":"ac7743fc7418d30a24b7e7dc7bddce1181a718fff3a9536c1335c2415f117c0c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-382.130","next":"us-ky/krs-382.140"},"notice":"GroundRules: Original legal text.
