{"data":{"id":"us-ky/krs-382.800","jurisdiction":"us-ky","citation":"KRS 382.800","heading":"Definitions.","body":"As used in KRS 382.810 to 382.860, unless the context otherwise requires:\n(1) \"Conservation easement\" means a nonpossessory interest of a holder in real\nproperty imposing limitations or affirmative obligations, the purposes of which\ninclude retaining or protecting natural, scenic, or open-space values of real property,\nassuring its availability for agricultural, forest, recreational, or open -space use,\nprotecting natural resources, maintaining or enhancing air or water quality, or\npreserving the historical,  architectural, archaeological, or cultural aspects of real\nproperty.\n(2) \"Holder\" means:\n(a) A governmental body empowered to hold an interest in real property under the\nlaws of this state or the United States; or\n(b) A charitable corporation, charitable association, or charitable trust, the\npurposes or powers of which include retaining or protecting the natural,\nscenic, or open -space values of real property, assuring the availability of real\nproperty for agricultural, forest, recreational, or open -space u se, protecting\nnatural resources, maintaining or enhancing air or water quality, or preserving\nthe historical, architectural, archaeological, or cultural aspects of real property.\n(3) \"Third-party right of enforcement\" means a right provided in a conservat ion\neasement to enforce any of its terms granted to a governmental body, charitable\ncorporation, charitable association, or charitable trust, which, although eligible to be\na holder, is not a holder.","path":["KRS Chapter 382"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35663","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:13Z","sha256":"ece1634e77ffc00dfbc7b278c88e14be503a58dbeb64b32d85af541034344203","source_id":"us-ky","stale":false,"prev":"us-ky/krs-382.796","next":"us-ky/krs-382.810"},"notice":"GroundRules: Original legal text.
