{"data":{"id":"us-ky/krs-382.810","jurisdiction":"us-ky","citation":"KRS 382.810","heading":"Creation -- Acceptance and recordation necessary -- Duration --","body":"Preexisting property interest.\n(1) Except as otherwise provided in KRS 382.810 to 382.860, a conservation easement\nmay be created, conveyed, recorded, assigned, released, modified, termin ated, or\notherwise altered or affected in the same manner as other easements.\n(2) No right or duty in favor of or against a holder and no right in favor of a person\nhaving a third-party right of enforcement shall arise under a conservation easement\nbefore its acceptance by the holder and a recordation of the acceptance.\n(3) Except as provided in KRS 382.820(2), a conservation easement shall be unlimited\nin duration unless the instrument creating it otherwise provides.\n(4) An interest in real property in exi stence at the time a conservation easement is\ncreated shall not be impaired by it unless the owner of the interest is a party to the\nconservation easement or consents to it.","path":["KRS Chapter 382"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35664","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:13Z","sha256":"b3d93ac6a75e4130f01817409a0079e2cbf5b27ca5a78d57c080d0a41dd456c6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-382.800","next":"us-ky/krs-382.820"},"notice":"GroundRules: Original legal text.
