{"data":{"id":"us-ky/krs-383.200","jurisdiction":"us-ky","citation":"KRS 383.200","heading":"Definitions of forcible entry and detainer.","body":"(1) The words \"possession,\" \"entry,\" \"detainer,\" in KRS 383.200 to 383.285, refer to\nlands and tenants.\n(2) A forcible entry is:\n(a) An entry without the consent of the person having the actual possession;\n(b) As to landlord, an entry upon the possession of  his tenant at will or by\nsufferance, whether with or without the tenant's consent.\n(3) A forcible detainer is:\n(a) The refusal of a tenant to give possession to his landlord after the expiration\nof his term; or of a tenant at will or by sufferance to gi ve possession to the\nlandlord after the determination of his will;\n(b) The refusal of a tenant of a person who has made a forcible entry to give\npossession, on demand, to the person upon whose possession the forcible\nentry was made;\n(c) The refusal of a person who has made a forcible entry upon the possession of\none who acquired it by a forcible entry to give possession, on demand, to him\nupon whose possession the first forcible entry was made;\n(d) The refusal of a person who has made a forcible entry up on the possession of\na tenant for a term to deliver possession to the landlord, upon demand, after\nthe term expires; and, if the term expires whilst a writ of forcible entry sued\nout by the tenant is pending, the landlord may, at his cost and for his benef it,\nprosecute it in the name of the tenant.","path":["KRS Chapter 383"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35699","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:13Z","sha256":"f8e76cfbb4ff89840bc2fce473955f650ad3685aa4a83bf45740db06250a60d0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-383.199","next":"us-ky/krs-383.205"},"notice":"GroundRules: Original legal text.
