{"data":{"id":"us-ky/krs-383.302","jurisdiction":"us-ky","citation":"KRS 383.302","heading":"Prohibited inclusion in rental or lease agreement  of authority to","body":"terminate on the basis of tenant's request for assistance in emergencies.\n(1) A  landlord shall not include in a residential rental agreement or lease for\nhousing a provision authorizing the landlord to terminate the agreement or to\nimpose a penalty on a tenant for requests made  by the tenant for assistance\nfrom peace officers or other assistance in response to emergencies.\n(2) A residential rental agreement or lease provision prohibited by subsection (1)\nof this section is unenforceable. If a landlord enforces a rental agreement or\nlease containing provisions known  by the landlord to be prohibited by this\nsection, the tenant may  recover actual damages  sustained by the tenant,\nreasonable attorney's fees, and all other costs incurred in bringing the action,\nand punitive damages of not more than two (2) months of periodic rent.\n(3) This section shall apply only to leases or rental agreements created or\nrenewed on or after June 29, 2017.","path":["KRS Chapter 383"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47053","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:14Z","sha256":"44a9695975aece4e97e401a5f798cda5e0eeb3dece6047a17d87d6d8788e13b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-383.300","next":"us-ky/krs-383.500"},"notice":"GroundRules: Original legal text.
